Man shot by police charged with pointing gun at them, authorities said

Police said Timothy Sauers pointed a gun at them after they went to check out a suspicious vehicle Thursday night.

TOMS RIVER -- A man shot by police after he allegedly pointed a gun at them has been charged with aggravated assault and weapons offenses in the Thursday night encounter in Toms River that left him hospitalized.

Timothy J. Sauers, 29, of Toms River, was charged with aggravated assault, possession of a weapon for an unlawful purpose and unlawful possession of a weapon, according to the police report.

The report said Sauers had an air gun, a spring gun or a pistol.

Ocean County Prosecutor Joseph Coronato said earlier Friday that Sauers pointed a handgun at Toms River police officers, who then shot him.

Coronato would not say how many times Sauers was shot or where he was shot but said he is expected to survive.

After the shooting, Sauers jumped over a cement bulkhead and into the Toms River, the prosecutor said. A search team found Sauers, wounded, about an hour later in the area.

Al Della Fave, spokesman for the prosecutor's office, would not say how many officers fired on Sauers.

Coronato said earlier that the officers encountered Sauers at 11:32 p.m. Thursday when they went to check out a suspicious vehicle near Cedar and Haines drives. During their interaction with him, the officers saw he had a gun, the prosecutor said.

Sauers remained hospitalized Friday night. When he is released, he will be transferred to the Ocean County Jail in Toms River where he will be held in lieu of $500,000 cash bail.

Because the shooting involved police officers, the prosecutor's office is heading the investigation along with the Ocean County Sheriff's Office's CSI Unit.
